Your Consent.

You acknowledge that by providing your personal information, you consent to the processing of your data in accordance with this privacy notice. You should read this notice in conjunction with the terms and conditions of use for the GameNation platform

You may deactivate your GameNation account or delete all information associated with your account by contacting NewComCustomerExperience@digicelgroup.com. If you do so, you will no longer have access to your GameNation account. Please note that we reserve the right to store and archive information needed to resolve disputes, enforce agreements, protect legal rights and/or comply with technical and legal requirements with regard to the security, integrity and operation of the Game Nation platform.

Changes to this Notice

Digicel may occasionally update the provisions of this policy, for example, where there has been a change/update in any applicable data protection legislation or regulation. In the event of a change or update, the revised notice will be published within the application. Updates and changes to the policy shall be effective as at the date of the publication within the application.

Personal Information We Collect

Digicel collects your personal data directly when you provide us with information through the platform; this is dependent on the products or services you use. This includes information you provide within the general use of the application, such as when you register to use the platform, create an account, set up a profile and complete a form or correspond with us.

We collect personal data such as your phone number, username, email address, and password.

  1. The type of messages (text message, video, photo, sticker, emoji)
  2. Type of services used
  3. Usage habits related to the application interface
  4. The last access to the application date
  5. Errors and information about the error which occurred during the use of the application

Purposes and Legal Basis for Processing Your Personal Data

Our legal basis for processing your personal data will vary depending on the type of data we are collecting, the context in which we collect the data, your country of residence and your location (as may be determined by your IP address and/or your device registration country).

Generally, we will process information about you where we have your consent, where we have a legitimate interest to do so, where the processing is necessary for the performance of a contract with you, and/or where we have a legal obligation to process your information.   1. your consent through your continued use of the application, after being informed or notified on how your data is being used;

  1. on contractual necessity to process information when you create an GameNation account to enable us to provide you with our services and/or products.

How we get your personal information

Most of the information that we process is provided to us by you:

  • When you register, browse and use the services available on our app;
  • When you get in touch with us or respond to communications from us; or
  • Directly from our affiliates with your consent.

Other data is collected through the use of various technologies:

Your Rights Regarding Your Personal Data

The application users have the right to:

  1. Right of access – the right to be informed of and request access to the personal data that GameNation processes about you
  2. Right to rectification – the right to request that GameNation amends or updates your personal data where it is inaccurate or incomplete
  3. Right to erasure – the right to request that GameNation delete your personal data
  4. Right to restrict – the right to request that GameNation temporarily or permanently stops processing all or some of your personal data
  5. Right to object- The right to object at any time to the processing of your personal data on the grounds relating to your particular situation
  6. Right to data portability – the right to request a copy of your personal data in electronic format
  7. Right to not be subjected to automated decision making – the right not to subject to a decision based solely on automated decision making, including profiling, where the decision would be a legal effect on you or produce a similarly significant effect

Who We Share Your Information With

We share your information with:

  • our subsidiaries and affiliates; and
  • partners and service providers involved on our behalf in delivering the services to you (that includes our payment gateway, app developers, and engagement platform provider);

We ensure there is a data processing agreement in place so that your personal information is only processed for a specified purpose and that it is protected in accordance with privacy laws.

How We Store Your Information

We take the appropriate technical and organisational security measures to protect your personal information against unauthorised access and unlawful processing, accidental loss, damage or destruction.

We keep your personal information for no more than is necessary for the purposes set out in this privacy notice unless we are required to do so for a longer period to comply with legal, tax or regulatory reasons. When we no longer need or are not required to keep your information we will securely delete your information and ensure all recipients of your data also comply with the same.

Where you have given us your consent to use your data and you decide to withdraw that consent, we will delete your personal data unless we are required to keep it for reasons we have explained above. We may need to keep a piece of your contact information e.g. your email address in our records so we know that you have withdrawn your consent and ensure we honour your choice.

Age Restriction

Users must be 16 years of age or older to subscribe, register or share any personal data to the application. It is not the intention of Digicel to solicit, collect or process personal data of users under the age of 16. If you believe we have inadvertently processed personal data of a user under 16, please contact us at the details provided. If we discover that we have inadvertently processed the personal data of any user under the age of 16, we reserve the right to delete it.

Retention Period of Personal Data

Digicel retains data for 90 days, however, certain data can be retained for longer periods as required by the laws of the territory within which the specific service is offered.
